if chick crashed kite then 1 second later dude smacks into line. chick at fault. shouldnt be crashing kites that close upwind of people. if you can control your kite get down wind and out of the say.
if chick crashes kite 40 seconds later numb nuts steam rolls into her. dude is at fault. he had at least 10 seconds before hitting her lines

OP's fault for doing it all for them  the 9m was down , she trying to relaunch , think the kite came up slightly , and his body went just under her lines and lines crossed and the kites spiraled around each other , and were twisted for a bit with pressure still in the kites laying in the water and i guess one was still tryign to relaunch and somehow the 12m twisted upon itself and shredded

And if he didn't have time to turn or stop, it would either be no one's fault or HIS FAULT because HE WAS TOO CLOSE TO HER. (likely checking her out or trying to impress) Generally, you can assume that the upwind kiter can not create a bigger buffer because they are presumably already going upwind as much as possible. On the other hand, the downwind kiter can always move downwind (unless it's too crowded - in which case = blameless accident). Richard M. Leeward rider has right of way which means if the windward rider can't go any more windward he or she must tack to get out of the way. And of course there is one over riding rule which trumps everything else, starboard, leeward, overtacking, powerboard, jetski this rule is the most important Do not crash into someone else Kook violated that simple rule. Doesn't matter what direction you are going or where you are.
