Kite surfers are considered vessels. Kite surfers must abide by all laws and regulations related to vessels including the City Municipal codes sections listed below:

Operate safely when on the open water.
Boating and Navigational “Rules of the Road” apply to kite surfing and must be observed.
Jumping and Jibing should be done at least 200 feet from the shore and far enough from other watercraft to ensure safety.

A launching vessel does have right of way over someone riding the waves or just riding close to shore.

A rider who is riding out through the surf does not have right of way over someone who has caught the wave.

i'm constantly amazed how many kiters of all skill levels do not use the thumbs up for launching and patting the head for landing. recently had a customer from europe, a very good advanced kiter, assit me with a launch (although i did not ask for assistance ... was self-launching and in the process of aborting the launch, as my bar had inverted), grab my ten session old, 2013 rally 12m and simply let it go! it luckily looped only once, but into a tree and tore the LE and burst the bladder. i asked him if he ever saw a thumbs up signal from me, much less ask for assistance. he just stared at me with a blank look on his face ... i had to exercise some serious compassion, although i was boiling inside.

In the event of a mishap the authorities would look at the boating rules. That said, steal someone's wave and the likelihood of a mishap just went waaay up. People need to be far more respectful of local rules, too many access points have already been closed!
