Same here, 2012 12m deformed in 20+ on multiple occasions. I should have just been out on my 9 at that time and I knew that, so I don't blame Airush much for that. Once the kite is in it's working range, I love this kite though.
I believe for 2013 year model this issue was adressed though, right?

A 9m fully depowered in 40 knots...it has nothing at all to do with design. I have had my 2012 VX 6m out in 40 knots and surprise surprise no deformation.
I read this a lot especially when bigger guys think because they are bigger they should be able to hold a certain size beyond its specified maximum wind range. The maximums are there for a reason, doesn't matter how big or small you are. No kite likes to be ridden depowered. If I even think about touching my depower more than a few inches I'm changing down.

I have the 2012 Varial X 12m and in 20 knots I have no problems with it as long as it is pumped good. I have felt a little wingtip flair when pushing 25 knots or if not enough pressure. I also have a 2013 Varial X 10m which got better. Still has to be pumped good but boy does this kite boost. I have ridden it gusting to 33 knots and solid 20-25 m jumps. Can't wait to try the 2014 VX 7-8m. It's a 3 strut kite this year.
The new Smart Bar has been awesome as well!

Any 9m or in any brand ive ridden has warped n smellyFished in 40knts out of its wind range.
Remember the 1 kite quiver guys wanted more bottom end - thats your trade off, self induced

That's 75 feet off the water.
If you're pulling solid 75 foot jumps, please film them and post them on Youtube...they will be very popular videos.
