In the USA kiters are considered to be vessels in terms of required safety gear and with regard to the Rules of the Road. This may vary elsewhere.

The primary mistake in both of these cases, was launching in those conditions in the first place and not a question of choice of gear, launching technique, etc.. I never had any luck with the remotes in water. Water seems to interfere with reliable performance. Perhaps a bag housing might improve the situation?

It is good to be aware of your surroundings, 360 degrees around you, on a routine basis. Boats, other kiters, kayakers, waterspouts, squalls, white water lines can move in with minimal warning, unless you are used to scanning your surroundings. Initially it isn't that easy but it is worth developing...
